HAMPTON, Ohio โ A sprawling investigation that began with vigilant store clerks and a DNA warrant has exploded into one of the most disturbing child sexual ๐ช๐ซ๐พ๐ผ๐ฎ cases in Ohio history, as a Benton County grand jury returned indictments against three separate defendants, revealing a web of familial ๐ช๐ซ๐พ๐ผ๐ฎ that prosecutors say extends far beyond the 16 children found living in squalor on Omar Street.
The indictments, unsealed this week, charge Gary Cers Jr. and his wife Elizabeth with multiple counts of sexual battery and unlawful sexual conduct with a minor, stemming from alleged ๐ช๐ซ๐พ๐ผ๐ฎ that occurred between January and September 2022. During that period, Elizabeth Cers was pregnant with twins, who tragically died the same day they were born.
The charges against the couple are only the beginning. The grand jury also indicted 23-year-old Josh Saunders, Gary Cers Jr.’ s nephew, on three counts of rape and one count of gross sexual imposition.
The alleged victims in those cases include a 9-year-old child, with the ๐ช๐ซ๐พ๐ผ๐ฎ spanning from January 2020 through December 2023. Additionally, 40-year-old Brandon Henderson, the longtime boyfriend of Gary Cers Jr.’ s sister Virginia, faces a staggering 21 counts, including eight counts of sexual battery, four counts of gross sexual imposition, and multiple counts of endangering children.
Benton County Prosecutor William Archer confirmed that the investigation began not with the Cers family, but with a separate child ๐๐๐ ๐ช๐ซ๐พ๐ผ๐ฎ case. Law enforcement sought the DNA of Gary Cers Jr. in connection with that initial probe, leading them to the Omar Street residence on June 30th.
What they found thereโ16 children living in deplorable conditionsโtriggered the second phase of the investigation. However, Archer was careful to note that the initial case involved intrafamily relations and did not pose a risk to the general public.
“These cases began as an investigation into family child ๐๐๐ ๐ช๐ซ๐พ๐ผ๐ฎ,” Archer said during a press conference. “Law enforcement sought the DNA of Gary Cers Jr. related to the child ๐๐๐ ๐ช๐ซ๐พ๐ผ๐ฎ case.
Once Cers Jr. was located, search warrants were executed to secure his DNA for genetic testing. Upon serving the search warrants for the child ๐๐๐ ๐ช๐ซ๐พ๐ผ๐ฎ case, the existence and condition of the 16 children at the Omar Street House became known.”
The revelation that the entire investigation was sparked by the observations of Dollar General clerks has added another layer of tragedy to the case. According to prosecutors, the clerks called authorities with concerns over children they observed, prompting the initial December 2025 investigation into allegations of sexual ๐ช๐ซ๐พ๐ผ๐ฎ involving two children. That probe, conducted by the Benton County Sheriff’s Office and the Ohio Bureau of Criminal Investigations (BCI), eventually led to the March 2026 opening of a second investigation into unlawful sexual conduct with a minor.
The timeline of the investigation reveals a methodical approach by authorities. The initial December 2025 probe focused on two children, leading to the indictments of Saunders and Henderson. Then, in March 2026, BCI opened a second investigation specifically targeting Gary Cers Jr.
and Elizabeth. It took nearly four months to track down the couple, who were not easy to locate. When authorities finally executed the search warrant on June 30th, they found the 16 Cers children, ranging in age from 1.
5 to 18 years old, in what has been described as “bad shape.”
The charges against Gary Cers Jr. and Elizabeth are specific and severe. Both face two counts of sexual battery and two counts of unlawful sexual conduct with a minor, all third-degree felonies.
The alleged victim in their case is not one of their own children, but is related to them. The victim was “quite young” when the alleged ๐ช๐ซ๐พ๐ผ๐ฎ occurred over a nine-month period in 2022, according to the prosecutor’s office.
Benton County Sheriff Ryan Kaine addressed the public’s growing concern about the June 30th raid on Omar Street, which had been the subject of intense speculation. “There have been a lot of speculation and questions regarding the June 30th presence on Omar Street in Hampton. These indictments provide some insight into the ongoing investigation.
However, to preserve the integrity of the ongoing investigation and to protect the victims, I conclude my statement here,” Kaine said, thanking his deputies and BCI partners.
The familial connections in this case are deeply tangled. Josh Saunders is the oldest son of Gary Cers Jr.’ s sister, Virginia, who goes by Jenny.
Brandon Henderson is Virginia’s longtime boyfriend and the father of some of her children. The couple has lived in Gallia County, Benton County, and Bloomer, Wisconsin. This Wisconsin connection is significant, as the Cers family also spent time there, likely explaining how the families remained intertwined.
Court records show that Virginia Saunders is still legally married to Josh Saunders’ father, Joshua Saunders Sr. , who is serving time in an Ohio prison for murder. He has been behind bars since 2009.
Despite this, Virginia described Brandon Henderson as her “soulmate” on Facebook in 2016. Earlier this year, both Henderson and Saunders Jr. were ordered by a court in Gallia County to undergo paternity testing for Virginia’s children to facilitate child support payments.
Those children are no longer in Virginia’s custody.
The investigation into the 16 Cers children has also resulted in charges against the grandparents, Gary Cers Sr. and his wife. The initial charges against Cers Sr.
were 17 second-degree felonies, but the grand jury indictment reduced that to 10 third-degree felonies and six misdemeanor counts. His attorney issued a pointed statement highlighting the reduction in both the number and severity of charges, suggesting that the state’s case is weakening as the investigation continues.
“Over a span of a month and a half, the number and severity of the charges against Mr. Cers Senior has already continued to decrease significantly with the state already admitting that further investigation continues to be necessary and ongoing and the defense’s investigation still yet to truly begin in earnest,” the statement read.
Legal experts say the reduction in charges for the grandparents is not unusual in complex cases where prosecutors must prove the level of injury, either psychological or physical, to the victims. Mark Weaver, a special prosecutor in Ohio who has handled numerous ๐๐๐ crimes cases, noted that the distinction between second-degree and third-degree felonies often hinges on the extent of damage done to the victim.
“The difference in these charges is the damage done to the victim,” Weaver explained. “And so, the more damage, the higher potential to get up to the F2, which is up to eight years in prison. There’s also a misdemeanor level, child endangerment.
Careless parent allows a child to sort of run outside into the street, three-year-old or something. That’s typically a misdemeanor, child endangerment. Nothing bad happened, but the child, the parent was being careless.”
Weaver also addressed the significance of the DNA warrant for Gary Cers Jr., suggesting it could indicate either physical evidence from a victim’s clothing or bedding, or a potential pregnancy resulting from the ๐ช๐ซ๐พ๐ผ๐ฎ. The fact that the warrant was for genetic testing, rather than a simple DNA match, suggests investigators are looking for a specific type of evidence that requires a comparison against a known suspect.
The investigation has also revealed the existence of a fourth and fifth case involving the Cers family, separate from the 16 children. While the initial charges against Gary Cers Jr. and Elizabeth Cers were filed under the name “Cers” โ a name that has been used in connection with the Cers family.
