A heartbreaking tragedy unfolded in Albuquerque, New Mexico, when a young mother’s moment of negligence led to the devastating loss of her two-year-old son. Amillia Garcia, 21, was sentenced to 10 years in prison after her son, Leon, fatally shot himself with a gun she had carelessly left on the couch.
According to prosecutors, the incident occurred in April 2026 while Garcia and her children were staying at an apartment with friends. While she reportedly slept, little Leon discovered the loaded firearm and accidentally shot himself in the chest. Tragically, he did not survive the incident.
In March, Garcia entered a guilty plea to charges of child abandonment resulting in death, with a firearm enhancement, as well as tampering with evidence. During her sentencing on July 8, she expressed profound remorse, stating, “I want to apologize for what has happened for my son’s passing. I am truly remorseful; I regret my actions and choices,” as reported by KOB 4.
Garcia claimed she had purchased the weapon for protection due to past domestic disputes, but prosecutors labeled her actions as reckless. “She knew that there was a serious risk of a firearm to anybody, let alone to her children getting those firearms,” said Savannah Brandenburg-Koch, the deputy district attorney.
While Garcia faced a potential 23-year sentence, the judge opted to suspend 13 years of her punishment. The incident also involved three other adults present at the time, two of whom allegedly took the gun and left the scene, leading to their prosecution as well.
In the wake of this tragedy, Albuquerque Police Chief Harold Medina emphasized the critical need for gun safety, urging parents to secure firearms away from children. “It is absolutely terrible, a 2-year-old is left with access to a firearm,” he stated. “This is a completely avoidable tragedy.”
